If an employer is willing to sponsor, although not legally stipulated, it is expected that a preliminary decision will be provided within 7 days by the Department of Home Affairs. -
Cool Skill Pathway
Salary and Sponsorship Requirement: The annual salary must meet or exceed AUD 73,150, plus superannuation, and employer sponsorship is required.
Occupation List Requirement: The occupation must be listed on the Cool Skills List to be eligible for sponsorship.
Occupation Assessment: Generally, the Skills Demand visa requires an occupation assessment. For applicants from Hong Kong, most occupations are likely to need an assessment, although there are some special cases where this can be bypassed. It’s important to confirm whether your occupation requires this assessment. -
Labour Agreement Stream
This pathway is more complex. In simple terms, it involves labour agreements between different companies, local governments, and the federal government. For example, if a region lacks sufficient waiters, a local employer can sponsor overseas workers through the Labour Agreement Stream via Skills International. However, this pathway is not commonly used by most Hong Kong applicants. We will dedicate an upcoming session to explain it in more detail. This pathway may later evolve into the “Essential Skill Pathway,” as mentioned in the Department of Home Affairs’ 2023 immigration strategy document, though it hasn’t been implemented as of December 2024. It is expected that further details will be released in 2025.
SID Visa Application Qualifications and Features

Visa Duration: Each applicant who successfully applies through any pathway will be granted a four-year visa. Hong Kong applicants may receive a five-year visa.

English Language Requirement: Applicants must achieve at least an IELTS score of 5.

Work Experience Requirement: Applicants must have at least one year of full-time work experience. Part-time work can also count, provided the total adds up to one year. The experience can be gained in Australia, overseas, or Hong Kong, but it must align with the nominated occupation’s skill level. For example, if the nominated occupation is accounting, work experience as a bookkeeper cannot substitute.

Employer Requirement: Importantly, applicants must have an Australian employer willing to provide a job. It’s essential to note that the employer’s company must have stable financial records to prove it can support the position. SID Visa Advantages and Risks

The SID visa is unique in that applicants can still apply for Australian immigration even if they are 50 or 60 years old. Each pathway offers the potential for permanent residency (PR), but applicants must be under 45 years of age to apply for PR. Those over 45 can only apply through the Hong Kong-specific pathway or the Labour Agreement Stream.

Employer Risks: One of the biggest risks is related to the employer. Compared to changes in government policy, an employer changing their mind is a higher possibility. If the employer backs out, the entire immigration application will be severely impacted.

Department of Home Affairs Risk: The Department will carefully scrutinise the authenticity of the nominated position. If the Department deems the position to be fake, the visa nomination will not be issued, and the application will be wasted. While the SID visa may seem to simplify the immigration process, the requirements for the employer have not been reduced. Employers must still meet a series of conditions, such as providing competitive wages and submitting business-related information, to verify the authenticity of the application. If the Department deems the application to be fraudulent, the visa application will be directly rejected.
Special Features of the CSOL Pathway
Under Australia’s Cool Skills List (CSOL), Australian employers are granted special powers. If an employer urgently needs overseas talent, they can apply for the 160 Significant Visa, which, if approved, allows the applicant to enter Australia and transition to permanent residency (PR). However, this visa has strict requirements:

The application processing time is longer, typically one to two years, and offshore applications may take even longer.
